Bylaws

 

Purpose

To provide an activity that encourages the involvement of both parent and child; where every swimmer participates and will gain a sense of accomplishment, feel good about himself; that develops good sportsmanship; and that provides an opportunity to enhance their competitive swimming abilities.

 

Article I: Naperville Park District Swim Conference

The River Run Raptors Swim Team is a member of the Naperville Park District Swim Conference and abides by the Bylaws, Rules, Policies and Procedures and the Code of Ethics (included) of the Naperville Park District Swim Conference and River Run Raptors Code of Ethics.

 

Article II: Membership

SECTION I: Membership

Subject to Article III, Section V, all children (up through graduating seniors from high school) whose parents are members of the River Run Club can be members of the River Run Raptors Swim Team, herein referred. (Also refer to Article II, Section IV).

SECTION II: Eligibility

1.MUST be able to swim the length of the River Run Club Pool (25 yards) without stopping, standing on the bottom, holding on to the sides or the lane lines. No inflation devices are allowed.

2.An eligible swimmer must be a registered member of the River Run Raptors Swim Team and must be listed on the official team rosters submitted to the Naperville Park District Swim Conference in accordance with the Naperville Park District guidelines.

3.Swimmers may only register on or before the designated registration dates. The only exceptions allowed are: swimmers whose families have joined the River Run Club as NEW members after the last registration date. No swimmers may register after the final registration established by the River Run Raptors Swim Team Executive Board.

4.Parents/Guardians are obligated to work the number of jobs designated by the River Run Raptors Executive Board during the Dual Meet Season and also be required to work at either the Classic or the City Conference Championship Meets and any other scheduled non-conference meets.

5.Parents who do not fulfill their obligation to work the designated jobs assigned to them during the Dual meet Season will be subject to any or all of the following penalties:

·of swimmer's participation in future meets.

·of swimmer's participation in Classic and City Meets.

·penalty not to exceed $200.00 as determined by the River Run Swim Team Executive Board.

If a parent has signed up to work at a meet at which his child is not participating, the parent is STILL required to work that meet unless he/she has arranged for a substitute, arranged another work date and NOTIFIED the Volunteer Chairperson. Meet line-ups will not be arranged around parent work schedules.

SECTION III: Age Groups

A swimmers age group will be determined by his age on the May 31 date just prior to the start of each season. A swimmer over 15 years of age may compete in the season immediately following his high school graduation. The River Run Raptor Swim Team Executive Board reserves the right to limit the maximum number of children in each age group as they see fit.

SECTION IV: Employees

Subject to Article III, Section V, employees of River Run Club, i.e. coaches, lifeguards, etc., are eligible to swim for the River Run Raptors Swim Team with the Registration fee waived and the parental work requirement waived.

 

Article III: Executive Board

SECTION I: The Officers

The Officers of the River Run Raptors Swim Team Executive Board will consist of President, Vice-President, Treasurer, Secretary, and Park District Representative. The Park District Representative will be a non-voting advisory member reporting to the Executive Board.

SECTION II: Election, Term and Vacancy

The Officers shall be elected by the River Run Raptors Swim Team Parent Membership at the River Run Raptors Swim Team Annual Meeting. Each Parent/Guardian will be allowed one vote. All Officers shall be elected for a one year term. Vacancies may be filled at any meeting of the River Run Raptors Swim Team Parent Board. Each new officer shall hold office until the end of the term of office.

SECTION III: Removal

Any Officer or agent elected or appointed by the River Run Raptors Swim Team Parent Board may be removed by the Board whenever, in its judgment, the best interests of the River Run Raptors Swim Team will be served thereby. A 2/3 vote of the River Run Raptors Swim Team Parent Board is necessary for the removal of said officer or agent.

SECTION IV: Powers and Responsibilities

The affairs of the River Run Raptors Swim Team shall be managed by the River Run Raptors Executive Board.

1.The President shall be the principle Executive Officer of the River Run Raptors Swim Team and shall in general supervise and control all of its business and affairs. The President shall preside at all meetings of the River Run Raptors Swim Team Executive and Parent Board, and sign, with the secretary or any other Officer authorized by the Board, any contracts or other instruments, which the Board has authorized to be executed.

2.The Secretary shall keep minutes of the meetings of the River Run Raptors Swim Team Executive and Parent Board in one or more books provided for that purpose; shall see that all notices are duly given in accordance with the provisions of these Bylaws; shall keep a register of the post office address of each River Run Raptor Swim Team Parent Board Member.

3.The Treasurer shall receive and give receipts for moneys due and payable to the organization from any source whatsoever, shall receive and authorize payment of all bills incurred on behalf of the River Run Raptors Swim Team; shall prepare and present the annual budget for review and approval by the River Run Raptors Swim Team Parent Board. The Treasurer shall close the books prior to the first meeting of the River Run Raptors Swim Team Executive Board following the River Run Raptors Swim Team Annual Meeting.

4.In the absence of the President or in the event of that officer's inability or refusal to act, the Vice President shall perform the duties of the President until the River Run Raptors Parent Board meets and elects a new President. The Vice President acts as a general chairman over all of the committees.

5.The Park District Representative will be a liaison between the Naperville Park District and the River Run Raptor Swim Team Executive Board. He/She will be responsible for attending the monthly meetings of the Naperville Park District.

6.The River Run Raptors Swim Team Executive Board shall decide how the moneys collected from registration fees are to be spent.

7.All moneys are to be used for the sole benefit of the River Run Swim Team.

8.The River Run Raptors Swim Team Executive Board has the sole responsibility of choosing the team swim suits, the T-shirts, caps or other articles of clothing, etc. that will be used by the River Run Raptors Swim Team.

9.Any disputes related to the River Run Raptor Swim Team will be handled by the River Run Raptor Swim Team Executive Board.

10.The River Run Raptors Swim Team Executive Board has the authority to deny membership to, or revoke membership at any time during the season, of anyone whose behavior is deemed, in the opinion of the River Run Raptors Swim Team Parent Board, to be unacceptable. Refund of any fees paid shall be made to anyone whose membership is revoked at any time during the season.

SECTION V: Executive Board Membership Exclusion

The parents of the River Run Raptors Swim Team Head Coach and Assistant Coaches will not be allowed to serve on the River Run Raptors Swim Team Executive Board. However, they will be allowed to serve on the River Run Raptor Swim Team Parent Board.

SECTION VI: Selection of Term of Committee Chairs

The President shall appoint, with the approval of the River Run Raptors Swim Team Executive Board, each committee chair. Each chair shall continue as such until the next annual meeting of the River Run Raptors Swim Team or until the President removes the chairperson from the position.

SECTION VII: Reports

Committee reports, in written form, shall be submitted to the River Run Raptors Swim Team Executive Board, at the end of the season when requested.

 

Article IV: Meetings

SECTION I: Annual Meeting

The Annual Meeting of the River Run Raptors Swim Team Parents Board shall be held following the swim team season for the purpose of presenting the River Run Raptors Swim Team Executive Board for the following season and for transaction of such other business as may come before the meeting.

SECTION II: Regular Meetings

Regular meetings of the Parent Board shall be held at times deemed appropriate by the River Run Raptors Executive Board.

SECTION III: Special Meetings:

Special meetings may be called by the President or the River Run Raptors Executive Board.

SECTION IV: Notice of Meetings

Notice, stating the place, day and hour of any meeting of the River Run Raptors Swim Team Executive Board shall be given each member of the Parent Board not less than five days before the date of such meeting.

SECTION V: Informal Action by the River Run Raptors Swim Team Board

Any action required to be taken by the Executive Board may be taken without a meeting provided:

1.A reasonably good faith effort is made to contact all Board members, setting forth the desired action, and

2.Any action passed must meet the voting requirements described in these Bylaws.

SECTION VI: Quorum

A majority of the total membership shall constitute a quorum for a meeting. The decision of a majority of the members present shall be that of the Parent Board, except where otherwise provided by these Bylaws.

SECTION VII: Voting Procedures

At any meeting of the River Run Raptors Swim Team Executive Board, a Board member entitled to vote, may vote only in person, or through the designation of a substitute Executive Board representative but not by written proxy.

 

Article V: Financials

SECTION I: Fiscal Year

The fiscal year of the River Run Raptors Swim Team shall begin on the first day of January and end on the last day of December in each year.

SECTION II: Budget

The annual budget must be approved by the River Run Raptors Swim Team Executive Board.

SECTION III: Fees

The River Run Raptors Swim Team Executive Board may determine the registration fee per swimmer. Fees shall be payable to the Treasurer at Registration.

SECTION IV: Checks, Drafts, Etc.

The Treasurer shall authorize payment by the River Run Raptors Swim Team of all checks, drafts, or other orders of payment of money, notes, or other evidences of indebtedness issued in the name of the River Run Raptors. In the absence of the Treasurer, the President shall assume this duty.

SECTION V: Contracts

The River Run Raptors Swim Team Executive Board may authorize, with a majority vote, to allow any Officer or Officers, agent or agents of the River Run Raptors Swim Team, in addition to the Officers so authorized by these Bylaws, to enter into any contract or execute and deliver any instrument in the name of and on behalf of the River Run Raptors Swim Team.

SECTION VI: Books and Records

The River Run Raptors Swim Team shall maintain correct and complete books and records of account. All books and records of the River Run Raptors Swim Team may be inspected by any member, of his agent or attorney for any proper purpose at any reasonable time.

SECTION VII: Annual Financial Report

A summary report or the River run Raptors Swim Team finances shall be made at least annually to the River Run Raptors Swim Team Parent Board. A copy shall be available by request for inspection by all members.

SECTION VIII: Gifts

The River Run Raptors Swim Team Parent Board may accept on behalf of the River Run Raptors Swim Team any contribution, gift, bequest, or device for the general purposes or for any special purpose of the River Run Raptors Swim Team.

SECTION IX: Insurance

The River Run Raptors Swim Team shall be in compliance with the Insurance provisions of the Naperville Park District Swim Conference.

SECTION X: Health and Safety

The River Run Raptors Swim Team Parent Board is advisory in nature with the final decision-making responsibility for all health and safety vested with the River Run Club and the Naperville Park District.

SECTION XI: Expenses

Any expenses in excess of $100.00 need approval by a majority vote by the River Run Raptors Swim Team Executive Board.

 

Article VI: Miscellaneous

SECTION I: Amendments

These Bylaws may be altered, amended, or repealed by a motion and second being made at a regular or special meeting followed by a vote of the Parent Board at a subsequent regular or special meeting. At the subsequent or special meeting a two-thirds affirmative vote of the Parent Board is required. No Bylaw may be amended or made to contradict any Bylaw, Rule or Policy and Procedure of the Naperville Park District Swim Conference.

SECTION II: Parliamentary Authority

Robert's Rules of Order, in its most recently revised edition, shall be the parliamentary authority governing all meetings and actions taken by the River Run Raptors Swim Team Parent Board, subject to state and federal laws, the Naperville Park District Swim Conference, and these Bylaws.
